1. Who we are

PAD.ai is a product of VisualPay LLC ("PAD", "we", "us"). We provide an AI-native lifecycle marketing platform that processes data on behalf of our customers (data controllers).

2. Data we collect

From customers (account holders)

• Account info: name, email, password hash (via Clerk), organization name.
• Billing info: name, address, last 4 digits of card (via Stripe; we never see full card numbers).
• Usage telemetry: pages viewed, actions taken, error events (for product improvement).

From customers' end users (profiles + events)

PAD processes the data your end users generate when interacting with your product, as described in your data processing agreement with us. You are the data controller; PAD is the data processor.

• Profile attributes you send via the SDK or API (external id, email, traits).
• Events you track (type, properties, timestamps, source).
• Send outcomes (delivery, open, click, bounce, complaint).

3. How we use the data

• To execute the lifecycle programs you configure (sends, segments, agent insights).
• To improve the product (aggregate, de-identified usage analytics).
• To detect abuse and protect deliverability for everyone.

We do not sell or rent your data. We do not train AI models on your data without an explicit opt-in.

4. Sub-processors

The following sub-processors handle data on our behalf:

• Neon — primary database (Postgres).
• Vercel — application hosting + edge compute + analytics.
• Upstash — Redis cache.
• Clerk — authentication and organization management.
• Resend — email delivery and inbound handling.
• Stripe — billing.
• Anthropic + OpenAI (via Vercel AI Gateway) — LLM and embedding models. Zero data retention enabled.
• Sentry — error tracking.

5. Retention

• Profiles + events: retained for the life of your account; you can delete on request.
• Sends: retained 18 months for deliverability auditing, then purged.
• Logs and traces: 30 days.

6. Your rights

You may request access, correction, export, or deletion of any data we process about you by emailing privacy@thevisualpay.com. We honor requests within 30 days.

7. Children

PAD is not directed to children under 16. We do not knowingly process data from anyone under that age.

8. Changes

We'll post material changes on this page and notify account owners by email at least 30 days before they take effect.
